When an apartment is heated by a landlord he must expect to provide a minimal temperature of 21 degrees Celsius in an apartment when it is cold. With Fall coming, the Rental Board insists on reminding us certain rules concerning the heating of an apartment.

There is no specifically set date on which heating should start. When the lease stipulates that heating is the responsibility of the landlord then the latter must heat the apartment whenever the temperature requires it.

One refers to jurisprudence to maintain minimal temperatures. Decisions rendered on this topic are determined by a disposition on heating held by the Regulations on the healthiness and the maintenance of dwellings belonging to the City of Montreal.

The Rental Board also reminds the tenant that he must see to it that the apartment will not be overheated and that he uses the heating equipment adequately. He should not leave the windows open for several hours in a row when it is possible to air a room for a few minutes.
